These terms and conditions apply to the use by you of the website located at www.willowpottery.com or any subsequent URL which may replace it (the "Website"). By accessing the Website and/or placing an order you agree to be bound by the terms and conditions set out below (the "Terms"). If you do not agree to be bound by the Terms you may not use or access the Website.

By using the Website you hereby agree to fully indemnify us, and our officers, directors, employees, agents and suppliers, harmless on demand, from and against any and all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising directly or indirectly out of any breach of the Terms by you or any other liabilities arising out of your use of the Website.
Our Rights
We reserve the right with or without notice to you to:
Temporarily or permanently, modify or withdraw the Website (or any part thereof) and you agree that we shall not be liable to you or any third party for any such modification to or withdrawal of the Website; and/or
change the Terms from time to time, and your hereby agree that your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change.
You have a responsibility to ensure you frequently check whether or not these Terms have altered. If you do not agree to any alteration or modification of the Terms you must stop using the Website immediately.
Making a Purchase
We have tried to make the checkout process as simple as possible, while protecting your security. Simply browse our store, adding any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for the details that we need to be able to complete the order.
We offer you a choice of Credit Card payment or PayPal to process payments. PayPal allows you to use your credit card, debit card or PayPal account to make a payment. You do not need a Paypal account to make a purchase. If you are shopping from an international location, place your order and your card company will convert the transaction to your own currency. We will take all reasonable precautions within our power to ensure the particulars of your order and payment remain secure. However, please be aware that in the absence of negligence on our part we shall not be liable for any loss suffered by you if a third party obtains any such information or personal data from the Website.
In the unlikely event we are unable to fulfil the order we will contact you to offer to cancel your order, or to make amendments to the order should you prefer.
If you have made a mistake in your order and cannot correct it in the shopping cart, please contact us and we will correct the mistake for you.
When confirmation of your order is received, this is to indicate that we have received your order. It does not indicate our acceptance of your order or that a contract exists between us. Order acceptance and the completion of your order will take place on the despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled your order in accordance with the Terms. We have included this term to protect us in the case that a mistake has been made in pricing or product description, we cannot obtain authorisation for your payment or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
Sale Items and Special Offers
Please note that items marked as on Sale or Special Offer may take a little longer to process and despatch.
Shipping and Handling
For UK shipping we will use either a courier or Royal Mail. In either case you may be asked to provide a signature on receipt, as proof that the goods have reached you.
Overseas Shipping
We are very happy to supply our goods to customers overseas. For Shipping to overseas countries, please contact us at by email at sales@willowpottery.com or by phone on 01225 891 919 for a quote.
Please note that we are unable to ship to PO Boxes, as our insurance does not cover this.
Delivery Schedule
We will normally despatch your order to you within 3 -5 business days provided we have the item in stock. International orders are generally despatched in under 5 days.
You must inform us within two working days if the goods are lost or damaged in transit so that we can make a prompt claim against the delivery company and correct the problem. Please quote your order number in all correspondence.
You agree that proof of delivery supplied by our delivery company is sufficient evidence to establish that goods have been received.
Back Orders/Special Orders
If your item is not in stock (this includes any items marked as 'Special Order'), we will back order for you. You will always be contacted with the option to cancel your order if you would rather not wait. We would generally expect all back orders to be filled within 2 weeks but will contact you in any case to advise of delivery timescales.
Credit Card Security
When the order is placed at our website, credit card numbers are encrypted using 128 bit encryption. They are only decrypted after they reach our computer. Payments are processed by our nominated payment platforms (including Paypal and Sagepay). We do not hold records of customer credit card details after payment is made unless authorised by the customer and then only in encrypted form and compliance with the security guidelines set out by our payment platform and UK law.
Privacy Policy
Any personal data you provide will be treated as confidential (unless we are requested by the police or any other public body with proper authority to provide it or we need to disclose it to a reputable third party such as a courier, in order to process your order) and be kept in a secure manner.
Any third party we disclose your personal data to will be under a duty to treat such data as confidential. Neither we nor any reputable third party we disclose data to will disclose any of your personal data to any other third party.
Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you register an account with us. They are also used after you have logged on as part of that process. You can turn off cookies within your internet browser if you wish. If you turn off cookies, you will be unable to place orders or benefit from the other features that use cookies. Data collected by this site is used to:
Take and fulfill customer orders.
Administer and enhance the site and service.
Only disclose information to third-parties for goods delivery purposes.
If we contact you for any of the above reasons whether by e-mail, letter or telephone you agree that you do not and will not consider such contact as a breach of any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003.

Please note that we periodically update the Website and therefore any product information contained on the Website may not accurately reflect the exact position at the moment you place an order with us. For example, we cannot confirm the price of a product until your order is accepted by us.
We are providing the Website on an 'as is' basis and make no representations or warranties of any kind with respect to the Website or its contents and hereby disclaim all such representations and warranties. In addition, we make no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published on the Website. It is our intention to provide accurate and helpful information, but the information contained on the Website may contain technical inaccuracies or typographical errors. Any liability by us howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
Although it is our intention to display the products as accurately and informatively as possible, please note that the display of any colour, texture or detail of a product could appear differently on your device's screen in comparison to the actual product itself.
Returns Policy
Your right to cancel this contract is protected under the Distance Selling Regulations.
You are entitled to cancel your order no longer than 7 working days after the day on which you receive the products for a full refund, including the cost of delivery. Do this by contacting us by email at sales@willowpottery.com quoting your name, address and the order number supplied to you. We will then provide instructions for how the goods can be returned to us.
Your refund will be paid within 30 days provided that all of the following requirements have been met:
1) you must notify us of your request for a refund, in writing - to either sales@willowpottery.com, or to our postal address - no longer than 7 working days after the day on which you receive the products
2) you have taken reasonable care of the products.
3) the products are returned to us in unused, clean and saleable condition
4) the original packaging is undamaged and intact
5) You are responsible for the cost and risk of loss or damage when returning the goods and their original packaging to us, so you should take out enough postal insurance to cover their value.
This cancelation policy does not affect your rights when we are at fault - for example, if goods are faulty.
None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.
Exchanging Goods
Goods may be exchanged for alternatives at our discretion.
In order for us to consider your request for an exchange, please submit your request in writing - to sales@willowpottery.com, or to our postal address - no longer than 7 working days after the day on which you receive the products. You must quote the order number supplied to you. If we accept your request, we will then provide instructions for how the goods can be returned to us.
Your exchange will be processed provided that all of the following requirements have been met:
1) you must notify us in writing to either info@willowpottery.com, or to our postal address, no longer than 7 working days after the day on which you receive the products
2) you have taken reasonable care of the products .
3) the products are returned to us in unused, clean and saleable condition
4) the original packaging is undamaged and intact
5) You are responsible for the risk of loss or damage when returning the goods and their original packaging to us, so you should consider taking out enough postal insurance to cover their value.
This cancelation policy does not affect your rights when we are at fault - for example, if goods are faulty.

Limitation of Liability
Neither we nor any of our directors, employees or other representatives will be liable for any loss or damage howsoever arising out of or in connection with the use of the Website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
Notwithstanding the foregoing, none of the exclusions and limitations in the Terms are intended to limit any rights you may have as a consumer under local law or other statutory rights which may not be excluded nor in any way to exclude or limit our liability to you for death or personal injury resulting from our negligence or that of our employees or agents.
Severance
The unenforceability of any part of the Terms will not affect the enforceability of any other part.
Waiver
No delay, act or omission by us in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.
Entire Agreement
The Terms contain the whole agreement between us relating to their subject matter and supersede any prior agreements, representations or understandings between us. You hereby acknowledge that you have placed no reliance on, and shall have no remedy in respect of, any representation (whether innocent or negligent) made but not expressly embodied in the Terms. Nothing in this clause limits or excludes any liability for fraud or fraudulent misrepresentation.
Third Party Rights
Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
Governing Law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
Shipping Policies
Willow Pottery accepts no responsibility if the signature received at the delivery address is not the intended recipient, and will consider the parcel correctly delivered.
Any customs or import duties, where required, are charged once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel.
Customs regulations and import duties vary widely across the world and may related to specific types of goods and/or their value. We recommend that you contact your local customs authority in advance of your purchase, if in any doubt.
Please note that we will always properly disclose the contents and nature of our shipments, in line with regulations imposed by our courier and customs authorities.
While we always select the most reliable and speedy shipping method feasible, regrettably sometimes things can be delayed for reasons beyond our control. In particular, international shipments can sometimes take longer than expected if goods are subject to delays passing through customs, for example. If your package is delayed and you haven't been able to locate it via the tracking information we sent to you, please contact sales@willowpottery.com and we will do our very best to help.
Should a parcel be lost or delayed due to a customer recording incorrect or insufficient delivery details, or as a result of unpaid import duties, we will not be responsible for any losses or problems which ensue. We will however do our very best to help you locate your parcel.
Credit Checks / Security Checks / Sale of Restricted Goods
Please note that all customer orders are subject to approval by the payment and security mechanisms we employ (for example Paypal, Sagepay, 3D Secure) and by our bank. In exceptional circumstances, orders placed may be deemed 'high risk' by the afore-mentioned agencies, in which case they will recommend that we seek further assurances before a shipment can be arranged. Regrettably, this may necessitate a lengthened delivery time.
